Terms of Service

1. Agreement

These Terms of Service constitute a legally binding agreement between VortexHosting and you, governing your access to and use of our services. By using our platform, you acknowledge that you have read and agreed to these terms.

2. Age Requirement

You must be at least eighteen (18) years of age to use the Services. By accessing or using the Services, you represent and warrant that you possess the legal authority to enter into this binding agreement.

3. Accounts

You are responsible for maintaining the confidentiality of your account information. VortexHosting is not liable for any loss arising from unauthorized access to your account.

4. Acceptable Use

Services must be used for lawful purposes. Prohibited activities include hosting illegal content, initiating DDoS attacks, or sending unsolicited emails (SPAM). Violation results in immediate termination.

5. Fees and Payments

You are responsible for all Fees set forth in your invoices. Billing commences when Services are available. Unpaid balances after 3 days may result in service suspension.

6. Refund Policy

All Services are generally non-refundable. We offer a 24-hour satisfaction guarantee for Shared Hosting and VPS services only. Dedicated servers and crypto-payments are strictly non-refundable.

7. Service Level Agreement

We strive for 99.95% uptime. Scheduled maintenance and third-party upstream issues are excluded from uptime calculations.

8. Data & Backups

Clients are solely responsible for their data. VortexHosting does not guarantee the availability of backups and is not liable for any data loss.

9. Termination

VortexHosting reserves the right to terminate service for any breach of these terms. Upon termination, data may be permanently deleted.

10. Limitations of Liabilities

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VORTEXHOSTING (OR OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST DATA, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF VORTEXHOSTING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, OUR SERVICES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO A MAXIMUM OF FIFTY US DOLLARS. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SUPPLIERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

11. Abuses

We take the liberty of monitoring and enforcing reports from abuseipdb.com, abuse@vortexhosting.es and abuse@reliablesite.net and Infrastructure providers.

12. Fees

Our rates are as follows:

IP Abuse: In the event that you/the client abuse any of our IP addresses and the case is reviewed and you are found guilty, you must pay a fee of €15 EUR for abuse.

Bandwidth abuse: Each service comes with a default bandwidth limit; if the customer abuses that bandwidth, they will be subject to a fee of €24.99 EUR.

Support Managed: We do not offer managed support on any rented service; managed support costs €35 one time.

Installation fees: Some of our services may have an installation fee; our installation fee is €4.99 EUR.
